Terms and Conditions

5.1 Credit Purchase and Allocation

• Credits can be purchased through our subscription plans (100, 300, or 500 credits per month).
• Each credit can be used for one (1) of the following operations:
  • One (1) script generation
  • One (1) blog generation
  • One (1) audio generation
• Credits can be used in any combination of the above operations.
• Credits are allocated monthly with your subscription and reset at the beginning of each billing cycle.
• Unused credits from the previous month do not roll over to the next month unless explicitly stated in your subscription plan.

5.2 Credit Deduction

• Credits are deducted immediately upon initiation of a generation request, regardless of whether the generation completes successfully.
• If a generation fails due to a system error on our part, we will refund the credit to your account within 48 hours.
• Credits are non-transferable and cannot be sold, traded, or exchanged for cash or other services.
• Credits have no cash value and cannot be redeemed for monetary compensation.

5.3 Account Credits

• You can view your current credit balance in your account settings.
• We reserve the right to verify credit balances and usage at any time.
• If we detect fraudulent activity or abuse of the credit system, we reserve the right to suspend or terminate your account and forfeit all credits.

6.1 Subscription Plans

We offer the following subscription plans:

• 100 Credits Plan: US$5 per month - For generating 100 in any combination script, audio, blog
• 300 Credits Plan: US$12 per month - For generating 300 in any combination script, audio, blog
• 500 Credits Plan: US$18 per month - For generating 500 in any combination script, audio, blog

6.2 Payment Terms

• All prices are in United States Dollars (USD) unless otherwise stated.
• Subscriptions are billed monthly in advance on the same date each month.
• Payment is processed through our third-party payment processor (Stripe).
• You agree to provide accurate and complete payment information.
• You authorize us to charge your payment method for all fees incurred in connection with your account.

6.3 Pricing Changes

• We reserve the right to modify our pricing and subscription plans at any time.
• Price changes will not affect your current subscription period. You will be notified of any price changes at least thirty (30) days before they take effect.
• If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.
• Continued use of the Service after the price change constitutes acceptance of the new pricing.
• We may introduce new features, plans, or pricing tiers at any time.
• Special promotional pricing may be offered at our discretion and is subject to the terms of the specific promotion.

6.4 Failed Payments

• If payment fails, we will attempt to process the payment again.
• If payment continues to fail, we may suspend or terminate your subscription and access to the Service.
• You remain responsible for all outstanding fees and charges.
• We are not responsible for any fees charged by your bank or payment provider.

8.1 General Refund Policy

• Due to the digital nature of our Service, all sales are generally final.
• Subscription fees are non-refundable except as explicitly stated in this section.
• Credits are non-refundable once purchased, except in cases of system errors as described below.

8.2 Eligible Refunds

We may provide refunds in the following circumstances:

• System Errors: If a generation fails due to a system error on our part, we will refund the credit used. Refund requests must be submitted within 7 days of the failed generation.
• Duplicate Charges: If you are charged multiple times for the same subscription period, we will refund the duplicate charges.
• Unauthorized Charges: If you report unauthorized charges on your account, we will investigate and refund confirmed unauthorized charges.
• Service Unavailability: If the Service is unavailable for more than 48 consecutive hours during your subscription period, you may request a prorated refund for the affected period.

8.3 Refund Process

• Refund requests must be submitted in writing to our support team within the applicable time period.
• We will review refund requests within 5-7 business days.
• Approved refunds will be processed to the original payment method within 10-14 business days.
• Refunds may take additional time to appear in your account depending on your bank or payment provider.
• We reserve the right to deny refund requests that do not meet the criteria outlined in this section.

8.4 Cancellation

• You may cancel your subscription at any time through your account settings.
• Cancellation will take effect at the end of your current billing period.
• You will continue to have access to the Service and your remaining credits until the end of your billing period.
• No refunds will be provided for the remaining portion of your subscription period after cancellation.
• Upon cancellation, your account will be downgraded to a free account (if available) or terminated.

9.1 Account Creation

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

9.2 Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated systems to access the Service without our prior written consent
• Interfere with or disrupt the Service or servers
• Generate content that is illegal, harmful, defamatory, or violates any third-party rights
• Share your account credentials with others
• Resell or redistribute content generated through the Service without proper attribution

10.1 Generated Content

• You own the content generated through our Service, subject to these Terms.
• You are responsible for ensuring that generated content complies with applicable laws and does not infringe on third-party rights.
• We do not claim ownership of content generated through the Service.
• You grant us a limited, non-exclusive license to use generated content for Service improvement, analytics, and support purposes.

10.2 Service Intellectual Property

• All intellectual property rights in the Service, including software, designs, and documentation, remain our property.
• You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.
• Our trademarks, logos, and brand names are our property and may not be used without permission.

11.1 Service Disclaimer

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We do not guarantee the accuracy, quality, or suitability of generated content for any particular purpose.
• You are solely responsible for reviewing, editing, and verifying all generated content before use.
• We are not responsible for any decisions made based on generated content.

11.2 Limitation of Liability

• To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
• We are not liable for any loss of data, profits, business opportunities, or other intangible losses.
• We are not liable for any content generated through the Service or how such content is used.
• Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

11.3 Third-Party Services

• Our Service may integrate with third-party services, including payment processors and AI providers.
• We are not responsible for the availability, accuracy, or reliability of third-party services.
• Your use of third-party services is subject to their respective terms and conditions.

13.1 Termination by You

You may terminate your account at any time by canceling your subscription and requesting account deletion through your account settings.

13.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• You fail to pay required fees
• We suspect abuse or misuse of the Service
• Required by law or court order

13.3 Effect of Termination

• Upon termination, your right to use the Service will immediately cease.
• All credits in your account will be forfeited upon termination.
• We may delete your account data and generated content after a reasonable retention period.
• Provisions that by their nature should survive termination will remain in effect.

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Narratum AI operates, without regard to its conflict of law provisions. If you are located outside this jurisdiction, local laws may apply to certain aspects of these Terms.

15.2 Dispute Resolution Process

• Before filing a claim, you agree to contact us first to attempt to resolve the dispute informally through good faith negotiations.
• If we cannot resolve the dispute within 60 days of your initial contact, you agree to resolve disputes through binding arbitration rather than in court, except where prohibited by law.
• Arbitration will be conducted in accordance with the rules of a recognized arbitration organization in our jurisdiction.
• You waive any right to a jury trial and to participate in a class-action lawsuit, except where such waiver is prohibited by law.
• Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Narratum AI regarding the Service.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet outages.
